Town Organized Farmers’ Market – proposed by the Foster Planning Board

Temporary Location: 110 Danielson Pike, Foster, RI – Plat 14, Lot 19B

 

RULES AND REGULATIONS

(Proposed)

 

The Proposed Town-Organized Farmers’ Market will be temporarily be located on property owned by South Foster Fire Department.

 

I. DEFINITIONS

 

Farmers’ Market (also the “Market”) is an occasional or periodic market, with goods offered for sale to the general public by individual sellers from open-air or semi-enclosed facilities or temporary structures.  The Market is composed of vendors with stalls, stands or spaces used for the purpose of the display and sale of merchandise, which can consist of home produced or locally grown farm produce or food, handmade artisinal crafts, art, informational booths on local conservation or civic programs, and live music

 

b. Home produced or locally grown shall mean produce, plants, animal products and other products produced within the Northeast food shed if not available from Rhode Island producers.

 

c. Market Manager is the individual designated to oversee the operation of the Market and with full responsibility and authority to enforce all rules of the Market.

 

d. Producer is a grower or producer of fruits, vegetables, edible grains, nuts and berries, and apiary products, which have been grown by the producer, or prepared by the producer in the case of jams, jellies, fruit and herbal vinegars, and sauces.

 

e. Vendor is the individual and/or entity selling the home produced or locally grown product at the Market.

 

II. OVERSIGHT/MANAGEMENT

 

The Market shall have a manager who is responsible for:

 

Being present at the Market whenever is it open and in operation; a temporary manager may be permitted in case of illness or other extenuating circumstances, on a case by case basis

Maintain records for the Market, including vendor records;

Vendor records shall include:

 

The name of the vendor;

The business address of the vendor;

The tax identification number for the vendor, or retail sales pernit if any is required;

The federal and/or state license number for the vendor, such as Department of Health, if any is required;

The product sold by the vendor; and

The location where the product is grown or produced

 

b. The Town Council shall appoint the Manager of the Market.

 

III. TOWN RESPONSIBILITIES

 

The Town shall receive confirmation from its insurer that a Town-organized Farmers’ Market is not excluded from coverage.

 

b. The Town shall review the property insurance policy for the temporary location of the Market.

 

c. The Town shall provide a police detail, or alternatively, arrange for the officer(s) on-duty during Market operation to make periodic passes and/or check-ins for the public convenience, health, safety and welfare.

 

d. The Town shall provide accessible bathrooms for the use of the Market vendors and attendees.

 

 IV. VENDOR RESPONSIBILITIES

 

To participate in the Town-organized Farmers’ Market, vendors must provide the Market Manager:

 

Vendor’s name and business address;

Product to be sold;

Location (farm name or address) where product is grown; and

The federal and/or state license and/or identification number for the vendor, retail sales permit such as Department of Health, Division of Taxation, IRS, etc., if any is required.

 

b. Vendors are responsible for the set up and take down of their own stall, stand and/or space, as well as making their space as presentable and neat and clean as possible during market hours

 

c. Vendors are responsible to clean the area surrounding their stall, stand and/or space so that the property is left in the same condition as it is found and must provide their own trash receptacle.

 

d. Vendors are responsible for the removal of any trash and/or waste created by their own stand.

            e. No hawking or shouting or music from any vendors or vendor booths
